If you usually reside in the EEA, UK or Switzerland (the “European Region”), where we refer to “TikTok”, “we” or “us” in this Privacy Policy, we mean TikTok Technology Limited, an Irish company (“TikTok Ireland”) and TikTok Information Technologies UK Limited (“TikTok UK”), a UK company.
If you usually reside in the United States (the “US”), where we refer to “TikTok”, “we” or “us” in this Privacy Policy, we mean TikTok Inc., a US company (“TikTok US”).
If you usually reside outside the European Region and the US, where we refer to “TikTok”, “we” or “us” in this Privacy Policy, we mean TikTok Pte. Ltd, a Singapore company (“TikTok Singapore”).
We are committed to protecting and respecting your privacy. This TikTok Shop Privacy Policy sets out the basis on which we process any personal information we collect from you, or that you provide to us, if you use TikTok Shop as a Merchant, Intellectual Property Rights (IPR) Owner, Creator or User, or if you visit or use related TikTok Shop applications or websites that are available from time to time and that link to or reference this TikTok Shop Privacy Policy. In particular, this TikTok Shop Privacy Policy applies where:
● Sellers (“Merchants”) promote and sell (“Offer”) goods (“Products”) to users of TikTok (“Users”) via the TikTok Shop;
● IPR Owners own and enforce IPR (such as trademark or copyright) against infringing Products in the TikTok Shop;
● TikTok creators (“Creators”) promote Products Offered by Merchants via the TikTok Shop; and
● Users buy Products from Merchants via the TikTok Shop.
This TikTok Shop Privacy Policy incorporates and supplements the TikTok Privacy Policy and the TikTok for Business Privacy Policy. This means that, for example, personal information we collect via the TikTok Shop will also be used for the purposes described in the TikTok Privacy Policy and TikTok for Business Privacy Policy. The TikTok Privacy Policy and the TikTok for Business Privacy Policy also include important information on your rights and how we store and protect your personal information. Any capitalized terms not defined in this TikTok Shop Privacy Policy have the meaning given to them in the TikTok Privacy Policy and the TikTok for Business Privacy Policy.

What information do we collect about you via the TikTok Shop?
If you are a User, we collect information needed to facilitate your purchase, the delivery of Products from Merchants and user support regarding your order, including for an extended warranty purpose. For example, when you purchase an item on the TikTok Shop, we may collect your name, address, card payment details, purchase history, and any additional information we process when you contact us or the Merchant for support via our Platform or by telephone. A more detailed list of information we collect from you is provided below.
If you are a Creator, we collect information regarding the Products you have chosen to promote, and related information regarding purchases and commission.
If you are a Merchant or IPR Owner, we collect information about you and/or your representatives necessary for you to register with and make use of the TikTok Shop, as well as any additional information we process when you chat with us, a Creator or a User via our Platform, or with us by telephone or email.
Where you are using a related TikTok Shop application or website, we also collect other information that you choose to provide to us, such as your contact information, as well as technical information that we automatically collect.
How do we use information collected about you via the TikTok Shop?
If you are a User, we use your information to perform our contract with you, including to allow you to purchase and receive Products you have ordered from Merchants, to personalize and customize your experience in Platform, and to provide further support related to the ordered Product, such as an extended warranty for certain products.
If you are a Creator, we use your information to perform our contract with you and for our legitimate interests in helping Merchants work with you to promote their Products based on your profile.
If you are a Merchant, we use your information to perform our contract with you and for our legitimate interests for the purposes of our due diligence, identity verification, fraud prevention and operation of the TikTok Shop.
If you are an IPR Owner, we use your information for the purposes of verifying your ownership of or the exclusive rights on the claimed IPR.
If you are a Merchant, IPR Owner, Creator or User, we will process your personal information for our legitimate interests to optimize and improve the features and functionality of the TikTok Shop.
Where you are using a related TikTok Shop application or website, we will use your information to provide that service to you, and to respond to you with the information you have requested.
Who do we share your information with if you use the TikTok Shop?
If you are a User, we will share your information with the Merchant you have ordered a Product from, as well as third party logistics providers to deliver your ordered Products, payment providers to facilitate your payment of the Product, and insurance brokerage companies and insurance companies for extended warranty purposes.
If you are a Creator, we may share your information with Merchants and/or TikTok Shop Partners (TSPs, including Creator Agency Partners (CAPs)) for the purposes of allowing them to select Creators to promote Merchants’ Products, and with payment providers to facilitate payment of commission. We may also share your performance data with the agency that represents or manages you.
If you are a Merchant, we may share your information with third party logistics providers and payment providers necessary to facilitate orders from Users.

1. The types of personal information we collect
If you are a User, we collect the following information:
● Contact information provided by you, such as your name, address, post code, telephone number and email address;
● Payment details that you provide, such as your credit or debit card information, payment authentication code and billing address;
● Purchase and transaction history that you provide in relation to Products that you purchase from Merchants via the TikTok Shop;
● Feedback or comments that you provide in relation to a Product or order;
● Logistics information from third-party logistics providers in relation to delivery of your Product by the third-party logistics provider on behalf of the Merchant;
● Products that you place in your shopping cart;
● Technical information that we automatically collect from you, such as your IP address, device ID, time zone and language settings;
● Additional information that you provide and that is required for extended warranty purposes, such as details of your ordered Products, ID card, bank account details, and photos of your damaged/repaired Products; and
● Information that we process when you contact us or the Merchant for support through the chat function provided by us via our Platform or by telephone, such as images of a Product or order, enquiries about a Product or order, or your evaluation of our support service.
If you are a Creator, we collect the following information:
● Contact information provided by you, such as your name;
● Information you provide regarding the Products you have chosen to promote, including the title, price, quantity, stock status and commission in relation to such Products;
● Information you provide regarding sales generated and purchase and transaction history and related video and live-stream metrics;
● Bank account information provided by you;
● Technical information that we automatically collect from you, such as your IP address, device ID, time zone and language settings; and
● Contact information (for example, email/phone number/WhatsApp account name) that you choose to provide through the E-Commerce Creator Center.
If you are a Merchant, we collect the following information:
● The name of your shop, shop logo, your name, whether you are a personal seller, the country your shop is located in, your phone number, your email address and category of Product (for example, clothes, toys, etc.) and related business information provided by you;
● If you are a company, contact details (such as name and phone number) of your legal representative(s) or contact person and identification documents (such as passport or national ID card) provided by you;
● If you are a personal seller, your identification information such as a copy or photo of your government-issued ID card or passport and your bank account information that you provide;
● Purchase and transaction history information and information on refunds and complaints that you provide;
● Logistics information from third-party logistics providers regarding shipment and delivery of Products, including by third party logistics providers;
● Technical information that we automatically collect from you, such as your IP address, device ID, time zone and language settings; and
● Information that we process when you contact us or when you interact with a User regarding support through the chat function provided by us via the Platform.
If you are an IPR Owner, we collect the following information:
● If you are a representative of a business IPR Owner, your contact details (such as name and phone number) and identification documents (such as passport or national ID card) that you provide;
● If you are a personal IPR Owner, details of your IPR ownership, your identification information such as a copy or photo of your government-issued ID card or passport that you provide;
● Your comments and interactions with us regarding enforcing your IPRs on the Platform; and
● Technical information that we automatically collect from you, such as your IP address, device ID, time zone and language settings.
If you are a User, Creator, Merchant, or IPR Owner and are visiting or using a related TikTok Shop application or website, we also collect other information that you choose to provide to us. This may include your contact information, such as your name, email address and phone number. We will also automatically collect technical information such as your IP address, device ID and browser information.
2. How we use your personal information
If you are a User, we use your information to perform our contract with you, where you order Products Offered by Merchants via the TikTok Shop. This includes sharing your additional information with Merchants and third-party payment providers for the purposes of fulfilling your order, sharing your information with third party logistics providers for the purposes of delivery of your Product(s) on behalf of the Merchant, and sharing your information with insurance brokerage companies and insurance companies for the purposes of providing an extended warranty over a certain Product to you. We also use your information, including information collected through your interactions with the TikTok Shop or related TikTok Shop websites or applications, to provide you with a customized experience in Platform, such as by suggesting Products you may want to purchase based on your previous purchases or other interactions with the Platform. We also use information that you provide us and/or we collect from you when you contact us via our Platform or by telephone for support, for the purposes of providing you with user support regarding your order, which may include responding to or processing your queries, feedback, claims or disputes.
If you are a Creator, we use your information to perform our contract with you, where Users have ordered Products and you are entitled to commission.
We will also use the content you upload, and related information such as the number of likes and responses you receive, and information about your followers for our legitimate interests to allow Merchants and/or TikTok Shop Partners (TSPs, including CAPs) to identify you based on your profile and to help Merchants decide whether they would like to work with you for the promotion of Merchants’ Products. We will also use this information, and information regarding sales attributed to you, for our legitimate interests to understand your performance with a view to exploring further collaboration with you.
If you are a Merchant, we use your information for our legitimate interests to verify your identity, to enable you to manage your store (including to open or close your store), to contact you with a view to improve and develop your business on the TikTok Shop, for risk management purposes and to prevent and respond to abuse, fraud, illegal activity and other potentially harmful content. We also use your information to perform our contract with you in relation to the TikTok Shop, such as to enable Users to order Products Offered by you via the TikTok Shop.
If you are an IPR Owner, we use your information for our legitimate interests to verify your IPR, to enable you to manage your IPR, for risk management purposes and to prevent and respond to abuse, fraud, illegal activity and other potentially harmful content.
If you are a Merchant or User, we collect and process, which includes scanning, analyzing, and reviewing, information you provide when you compose, send, or receive messages through the Platform’s messaging functionality to Merchants, buyers, and/or with any virtual assistant in order to provide messaging functionality, enhance the user experience, and perform our contract with you. For example, we scan and analyze incoming and outgoing messages through the Platform's messaging functionality to allow user inquiries regarding Merchants’ Products, provide support for the ordered Product, and to personalize and customize your experience on the Platform. We also process messages sent or received between Merchants and Users to investigate and resolve complaints or disputes between Merchants or Users. We process such personal information for the purposes of our legitimate interests in investigating and resolving such complaints or disputes between Merchants and Users. We will also process messages sent or received between Merchants and Users to detect and combat abuse, harmful activity, fraud, spam, and illegal activity on our Platform, and to ensure your safety and security, including reviewing such messages and content and associated metadata for breach of our Community Guidelines, Terms of Service and other policies.
If you are a Merchant, IPR Owner, Creator or User, we will process your personal information for our legitimate interests to optimize and improve the features and functionality of the TikTok Shop and for risk management purposes and to prevent and respond to abuse, fraud, illegal activity and other potentially harmful content.
If you are a Merchant or a third party that uses the TikTok Shop Open Platform, we collect, use and store the personal information listed above in order to provide and administer the TikTok Shop Open Platform.
If you are a User, Creator, Merchant, or IPR Owner and are visiting or using a related TikTok Shop application or website, we will also use your information to provide that service to you, to interact with you including by responding to you with the information you have requested, providing customer support or sending you marketing messages in accordance with your preferences.
3. How we share your personal information
If you are a User, we share your information with Merchants, their authorized service providers, and third-party logistics providers to process and facilitate your order and delivery of a Product from Merchants. By making a sale or a purchase on TikTok Shop, you are directing us to share your information in this way. To process your payment, we also share your information with payment providers including, in particular, the following third-party payment providers/processors: PayPal (https://www.paypal.com/us/webapps/mpp/ua/privacy-full) and Stripe (https://stripe.com/en-ie/privacy). To provide you with an extended warranty for certain products, we also share your information that is relevant to the extended warranty to insurance brokerage companies and insurance companies.
We may also share your information with certain affiliated entities in our corporate group to provide services to you as described in the TikTok Privacy Policy, as well as with Merchants to the extent necessary to allow the Merchant to initiate communications with you to provide you with user support under limited circumstances regarding your order, including the necessary steps to be taken in a situation when the Product is out of stock.
If you are a Creator, we share certain information about you with Merchants and/or TikTok Shop Partners (TSPs, including CAPs) for the purposes of allowing Merchants or TSPs to select Creators for the promotion of Merchants’ Products, and with payment providers to facilitate payment of commission. We may also share your performance data with the agency that represents or manages you so that the agency can fulfill its contractual obligations with you.
If you are a User or Creator, note that Merchants, developers and logistics providers may be located outside of the European Region, or the country you usually reside in.
If you are a Merchant, we may share your information with payment providers and third party logistics providers to the extent necessary to facilitate orders of Products from Users.
